1. Definitions
  2. Price – gross amount of remuneration expressed in euro (taking int account the applicable tax) due to the Seller on the basis of the Product sales Agreement. The price does not include delivery costs, unless otherwise stated in the Regulations.
  3. Initial Price – the lowest Product Price that was in effect during the 30 days prior to the discount/promotion.
  4. Promotional price – Price after the introduction of the promotion by L-TEK.
  5. L-TEK – L-Tek Spółka z ograniczoną odpowiedzialnością with its registered office in Gorzeń Dolny 157, 34-100 Wadowice, entered in the Register of Entrepreneurs of the National Court Register under KRS No. 0000717355, NIP 551-263-41-53, REGON 369435568.
  6. Password – a sequence of alphanumeric characters necessary for authentication when accessing the Client’s Account, specified by the Client when creating the Account.
  7. Client –  natural person with full legal capacity, as well as a legal person or an organisational unit without legal personality, to which legal capacity is granted by law, making purchases in the Internet Store. A Consumer or an Entrepreneur may also become a Client.
  8. Consumer  – a natural person making a legal transaction with a trader which is not directly related to his/her commercial or professional activity.
  9. Client’s  Account – a digital collection of resources and rights assigned to a specific Customer who has fully registered, used for the fulfilment of placed Orders with logging into the Customer Account, containing order history, Customer’s preferences regarding selected products available in the Internet Shop www.maty-taneczne.pl, data on payments and orders.
  10. Shopping Cart –service provided electronically enabling the Customer to place an Order, enter discount codes regulated by separate regulations, display a summary of the Order and individual Product Prices as well as the total Price of the Products included in the Order.
  11. Login – the Customer’s e-mail address provided within the Internet Shop when creating a Customer Account.
  12. Product – ta product offered by L-TEK in the Internet Shop.
  13. Entrepreneur – a natural person, a legal person, and an organisational unit without legal personality, to which legal capacity is granted by law, conducting a business or professional activity in their own name and using L-TEK’s services in direct connection with their business or professional activity.
  14. Regulations – these regulations for the provision of electronic services;
  15. Registration – the process of creating a Customer Account by the Customer.
  16. Website – website run by L-TEK at www.maty-taneczne.pl.
  17. Internet Store maty-taneczne.pl/ Internet Store– on-line sales platform managed by L-TEK allowing the Client to place orders, available at the following website: www.maty-taneczne.pl.
  18. Seller – L-TEK, concluding the Sales Agreement with the Customer.
  19. Provision of services by electronic means – the performance of a service provided without the simultaneous presence of the parties (at a distance), through the transmission of data at the individual request of the recipient of the service, sent and received by means of equipment for electronic processing, including digital compression and storage of data, which is entirely transmitted, received or transmitted via a telecommunications network within the meaning of the Act of 16 July 2004 – Telecommunications Law;
  20. Sales Agreement a sales agreement within the meaning of the Civil Code concluded using means of distance communication, concerning the sale by the Seller to the Customer of a Product against payment of the Price plus any additional charges, including shipping costs, the Regulations of which are set out in particular in the Regulations.
  21. Act on Consumer Rights – Act of 30 May 2014 on consumer rights (Journal of Laws 2014, item 827 as amended).
  22. User – a person visiting the website maty-taneczne.pl, as well as a person using the available services on the websites, e.g. newsletter sign-up.
  23. Order – a declaration of will by the Customer expressing a direct will to conclude a Sales Agreement, specifying the Products for which the Customer is making an offer of a Sales Agreement and the Customer’s data necessary to perform the Sales Agreement.
  1. General Provisions
  2. The Regulations set out the Regulations for the provision of electronic services through the Service by L-TEK.
  3. L-TEK. is the owner and administrator of the Service
  4. The User should read the Regulations and Privacy Policy before registering on the Website. By registering on the Website, the User confirms that he or she has read the Regulations and accepts the provisions contained therein in full and without reservation. This declaration is made by marking an active field, specified and visible in the course of the Registration.
  5. Pursuant to Article 8(3) of the Act on Provision of Services by Electronic Means, the Regulations set out in particular:
  6. types and scope of services provided electronically,
  7. Regulations for the provision of services by electronic means,
  8. Regulations for the conclusion and termination of agreements for the provision of services by electronic means,
  9. complaint procedure.
  10. The Regulations are made available to the User free of charge via www.maty-taneczne.pl, in a form that allows them to be obtained, reproduced and recorded.
  11. Use of the Website requires the User to meet the following specific requirements:
  12. a computer or other device with Internet access;
  13. active e-mail accounts,
  14. we recommend using an up-to-date version of your browser, e.g. Firefox, Chrome, Internet Explorer or other software with similar features and functions.
  15. L-TEK shall be waived from responsibility for technical errors caused by the User’s failure to meet the technical requirements.
  1. Providing Services by Electronic Means
  2. By means of the Service, L-TEK – provides in particular the following electronic services:
  3. information services – consisting of making available, at the individual request of the Customer, information placed within the Service by displaying a page with a specific URL, containing information data individually requested by the User,
  4. Customer Account
  5. search engine – allowing parties to search for Products in the Internet Shop,
  6. favourites (Wishlist) – consisting of the possibility for the Customer to save certain Products of his or her choice; adding a Product to Favourites does not imply its reservation,
  7. Internet Shop services – allowing the Customers to place Orders and conclude a Sales Agreement in accordance with the principles set out in the Regulations,
  8. social network plug-ins – which consist in enabling direct passage of the User from the Service to the L-TEK Fan page/account in a given social network,
  9. opinions on Products – which allows a logged-in Customer to leave an opinion on a Product purchased and allows the User to read the opinions of Customers,
  10. Shopping Cart
  11. Comparison of offers (“Compare”) – enabling the Customer to compare between several Products offered in the Internet Shop. Use of the service does not require a login to the Customer Account.
  12. promotions – covered by separate Regulations, available on the Website,
  13. application – the rules for the provision of the service are set out in separate regulations.
  14. In addition, the Seller, for the benefit of Customers who have created a Customer Account, shall provide, free of charge, via the Internet Shop, services to maintain the Customer’s session after the Customer has logged into the Customer Account and to store and make available, via the Customer Account, the history of Orders, the status of Orders and Complaints submitted.
  15. In order to use the Customer Account, the Customer shall be required to register using the form and accept the Regulations.
  16. The customer shall confirm the registration of the Customer Account by means of an activation link sent to the e-mail address provided when filling in the registration form. With the confirmation referred to above, the agreement for the provision of the Customer Account is concluded. This service is provided free of charge for an unlimited period of time.
  17. When registering a Customer Account, the Customer sets up a Password. The password can be changed by the Customer at any time after logging into the Customer Account. The Customer is obliged to keep the Password confidential (not to disclose it to any third party).
  18. The Customer may at any time and without stating any reason delete the Customer Account by sending a request to the Seller – in particular by e-mail to the following address biuro@l-tek.pl or in writing to the address: L-TEK Sp. z o.o., Gorzeń Dolny 157, 34-100 Wadowice.
  19. Establishing a Customer Account is not required to place an Order.
  20. With regard to social network plug-ins, L-TEK exclusively provides the plug-ins through their corresponding posting on the Service. Both the operation of the plug-ins and the social networks themselves follow the rules of the respective social networks and are independent of L-TEK. To the fullest extent permitted by law, L-TEK is not responsible for the operation of plug-ins and social networks.
  21. Any Customer who purchases a Product can leave a Review. For this purpose, after the purchase, the customer will receive an e-mail with a link enabling him or her to submit an opinion.
  22. The Rating service allows the user to add an opinion on a Product by entering a comment in the appropriate form and marking the stars from 1 to 5, on the understanding that 1 star is the worst rating and 5 stars the highest rating. Adding the content of an Opinion is optional.
  23. An opinion can only be given by a logged-in Customer who has purchased the rated Product in the L-TEK Internet Shop.
  24. Published Product Reviews are published in the Internet Shop with the User’s name or nickname included in the Customer Account. Other details of the customer’s identity shall not be published.
  25. The opinion must not contain content covered by intellectual property rights of third parties.
  26. In justified cases, in particular due to the incompatibility of the content with the Terms of Use, an opinion may be moderated, i.e. published only in a part that does not violate the Terms of Use, or it may be completely removed both before its publication and at a later date.
  27. The use of the Shopping Cart takes place when the Customer adds the first Product. Placing a Product in the Shopping Cart does not result in its reservation in the Internet Shop.
  28. The use of the Shopping Cart does not require registration or logging into a Customer Account.
  29. When using the Shopping Cart, the Customer also has the opportunity to enter discount codes provided for in separate regulations and to summarise his/her Order.
  1. Internet Shop – Conditions of the Sales contract
  2. The conclusion of the Contract of Sale takes place through the submission of the Order by the Customer and subsequent payment of the price and confirmation of the Order by the Seller.
  3. The Customer may place an order by registering or logging into a Customer Account or without registering a Customer Account.
  4. Placing an Order without registration – in order to place an Order without registration, the Customer is required to provide the following details on the order form available on the Internet Shop:

    1. Delivery address,
    1. Data necessary for VAT invoice – for customers requesting a VAT invoice.
  5. Placing an Order through the Customer Account – in order to place an Order through the Customer Account, it is necessary to:
  6. the Customer logs into his/her Customer Account,
  7. product selection,
  8. choice of payment method,
  9. choice of delivery method,
  10. placing an Order.
  11. Under each of the Products made available in the Internet Shop, there is a detailed description of the Product, including, among other things, price, parameters, dimensions, weight, information on possible delivery time. The price shown with the description of the Products does not include the price of delivery.
  12. The Seller sends a confirmation of the Order to the Customer at the e-mail address indicated when the Order was placed.
  13. Before placing an Order, the Customer who does so without registering a Customer Account is obliged to accept the provisions of the Regulations. If the Regulations are not accepted, no Sales Agreement is concluded.
  • Payment methods and deadlines
  • The customer can pay online via PayPal or the STRIPE service.
  • The customer chooses the method of payment at the time of placing the Order.
  • Failure to pay within 24 hours of placing the Order will result in its automatic cancellation.
  • In the event that, after payment has been made, the Customer does not take delivery of the Order and the Order is returned to the Seller, the Seller will refund the amount paid by the Customer in the same manner as the payment was made.
  • Delivery
  • Delivery of the Order is available worldwide.
  • Delivery of the Product to the Customer is charged extra – according to the price list of the carrier selected by the Customer. Information on the amount of the delivery charge is indicated when selecting the delivery method and when summarising the Order.
  • The customer chooses the method of delivery method when placing the Order.
  • The total waiting time for the Customer to receive the Products (delivery time) consists of the time for the Seller to prepare the Order for dispatch and the time for the carrier to deliver the Products.
  • L-TEK shall forward the Product for dispatch within 24 hours of the Order being placed. The delivery time depends on the carrier selected by the Customer, while L-TEK makes every effort to ensure that delivery is made as soon as possible.
  • The seller shall not be liable for any delays by the carrier in the delivery of the parcel to the fullest extent permitted by law.
  • The Customer can check the delivery status of his/her Order by logging into his/her Customer Account or, if he/she has not registered a Customer Account, by entering the consignment number on the website of the delivery carrier.
  • The Seller shall inform the Customer of the dispatch of the product by e-mail to the e-mail address indicated when placing the Order.
  • Complaints
  • The customer may lodge a complaint relating to the provision of electronic services as follows:
  • via the contact form on the Website in the “Contact” tab.

  • In order to expedite the processing of the complaint by L-TEK, it is recommended that the following information be indicated in the description of the complaint:
  • information and circumstances relating to the subject of the complaint, in particular the nature and date of the irregularity,
  • client requests,
  • the contact details of the person making the complaint.
  • If any of the above information is missing, the Seller will ask the Customer making the complaint to complete it.
  • The time limit for processing a complaint – also a warranty complaint – is 14 working days from the moment the Seller has all the necessary information for this. If the Seller does not refer to the complaint within this period, it shall be deemed to have been resolved in favour of the Customer.
  • Warranty and Guarantee
  • The Seller shall be liable to the Customer for a physical or legal defect in the Product (warranty) on the basis of Article 556 et seq. of the Civil Code.
  • The Seller is obliged to provide the Customer with a defect-free Product.
  • A warranty claim may be made by the Customer in the manner set out in clause. VIII of the Regulations.
  • In the case of a warranty complaint, the Customer should – in addition to the information indicated in point VIII of the Regulations – provide the Seller with the defective Product – to enable the Seller to examine it.
  • The Seller shall make it possible for the Customer to deliver the Product complained of to him free of charge – details can be found on the Website under the “Contact” (“Contact”).
  • In the event that a sold Product has a defect, the Customer may:
  •  file a request for reducing the price or for withdrawal from the agreement, unless the Seller immediately and without undue inconvenience to the Buyer replaces the defective item with an item free of defects or removes the defect. The reduced price shall be in such proportion to the contract price that the value of the Product with the defect remains to the value of the Product without the defect;
  • demand that the Product be replaced with a defect-free one or that the defect be rectified. The Seller is obliged to replace the defective Product with a defect-free one or to remove the defect within a reasonable time without excessive inconvenience for the Customer;

– subject to the reservations and conditions set out in the relevant provisions of the Civil Code.

  • The Customer may, instead of the rectification of the defect proposed by the Seller, demand the replacement of the Product with a defect-free one or, instead of the replacement of the Product, demand the rectification of the defect, unless bringing the Product into conformity with the agreement in the way chosen by the Customer is impossible or would require excessive costs in comparison with the way proposed by the Seller. In assessing the unreasonableness of costs, the value of the defect-free Product, the nature and significance of the defect found and the inconvenience to which other means of satisfaction would expose the Customer shall be taken into account.
  • The Customer may not withdraw from the Contract if the defect in the Product is immaterial;
  • The warranty complaint procedure is governed by the procedure set out in point VIII of the Regulations and the provisions of the Civil Code.
  • The Seller shall be liable under the warranty if a physical defect is discovered before the expiry of two years from the date of delivery of the Product to the Customer. A claim for rectification of a defect or replacement with a defect-free Product shall become time-barred one year from the date on which the defect was detected, however, in the case of an Order placed by a Consumer, the period of limitation shall not end before the expiry of the period referred to in the first sentence.
  • The manufacturer (Guarantor) of the Products sold through the Internet Shop is L-TEK.
  • The guarantor guarantees the smooth operation of the sales item for a period of 12 months from the date of issue. The document containing the guarantee statement is enclosed with each Product purchased.
  1. Withdrawal From the Sales Agreement
  2. A consumer who has concluded a Sales Agreement may withdraw from it without giving any reason within 14 days from the date of receipt of the Order from the carrier (“statutory right of withdrawal”).
  3. In order to meet the deadline for withdrawal from the Sales Agreement, the Consumer should submit a statement of withdrawal:
  4.  via the Customer Account,
  5. via the form on the Website under the “Agreement” tab,
  6. or in writing to L-TEK.
  7. A model declaration of withdrawal from the Sales Agreement is attached to the Regulations. the consumer may use the model declaration, but it is not necessary for its validity.
  8. In the event of withdrawal from the Sales Agreement, it shall be deemed not to have been concluded, so that the Seller and the Consumer are obliged to return the services/goods provided to each other, i.e. the Seller shall return the payment made by the Consumer and the Consumer shall return the Products purchased. Both will be refunded within 14 days of the declaration of withdrawal.
  9. The refund of the payment made shall be made using the same method of payment that the Consumer used for the Order within 14 days.
  • Personal Data
  • In order to perform the Services, the Seller processes personal data of Users, Customers and other individuals using the Services.
  • The Vendor shall exercise due diligence to ensure that the processing and protection of personal data comply with the relevant legislation, in particular the General Data Protection Regulation (GDPR), information society services and privacy legislation.
  • The extent of the personal data processed depends on the Services used by the data subject.

  • Some Services, in particular the Website, the Internet Shop and the Seller’s social media also use cookies and other tracking tools. Detailed information on their use can be found in the Cookie banner available on the Website and in the Cookies Policy available at the link: https://www.iamats.com/personal-data-protection-policy/.
  • Every data subject has the right to exercise all the rights concerning the processing of their personal data set out in the RODO or other specific legislation. In any case, the data subject may contact the Vendor for further information, clarification and support in exercising the rights set out in the DPA.
  • Termination of the Agreement and Amendments to the Regulations
  • The Seller may terminate the agreement for the provision of services by electronic means with 14 days’ notice, as well as may restrict its access to part or all of the Customer’s Account or refuse the Customer’s further right to use the Internet Shop (both those with and without an Account) and to place Orders, for valid reasons, in particular in the event of a gross breach of the Regulations by the Customer.
  • The Seller may terminate the contract for the provision of electronic services with immediate effect in the event of successive gross violations of the Regulations by the Customer or inactivity in the Customer’s Account for 12 consecutive months.
  • The Seller may amend the provisions of the Regulations. If such changes are made, the Seller shall make the consolidated text of the Regulations available on the Website and send it to the electronic address of Customers and Users provided by them in the Internet Shop or on the Website.
  • The amendment to the Regulations shall take effect 14 days from the date on which notice of the amendment is sent. In the case of Customers who have registered a Customer Account, they have the right to terminate this agreement within 14 days of being notified of the change to the Regulations.
  1. Out-of-court Handling of Complaints and Assertion of ClaimsL-TEK agrees to submit any disputes arising in connection with the sale of the Products to mediation. Details will be agreed between the disputing parties. Any disputes related to the services provided by L-TEK shall be settled by common courts, and the applicable law is Polish law. The customer, who is a Consumer, has the possibility to use an out-of-court complaint and redress procedure. The rules of access to these procedures are available in the offices and on the websites of district (city) consumer ombudsmen, social organisations whose statutory tasks include consumer protection, voivodeship trade inspection inspectorates and at the following Internet addresses of the Office of Competition and Consumer Protection:

  5. The customer who is a Consumer also has the possibility to use the platform of the online dispute resolution system between consumers and traders at EU level – through the ODR platform, available at http://ec.europa.eu/consumers/odr.

  1. Final Provisions
  1. The Regulations shall enter into force on 1.12.2022.
  2. The contents of the Regulations are available to the Clients free of charge under the following URL address: https://www.iamats.com/regulations/
  3. In matters not regulated by the Regulations the appropriate provisions of the Civil Code shall apply, in particular: Civil Code; the Act on Provision of Electronic Services of 18 July 2002 (Journal of Laws 2002 No. 144, item 1204 as amended); the provisions of the Consumer Rights Act of 30 May 2014. (Journal of Laws 2014, item 827 as amended); and other relevant provisions of generally applicable law.
  4. The selection of Polish law on the basis of these Regulations does not deprive the Consumer of the protection granted to him/her under provisions that cannot be excluded by agreement between the Seller and the Consumer under the law that would be applicable under the relevant regulations in the absence of the choice.
